Terms & Conditions

By making a reservation or renting a vehicle from Modern Rent A Car ("we," "our," or "us"), you ("Renter") agree to be bound by these Terms and Conditions. Please read them carefully before completing your reservation. If you do not agree to these terms, do not proceed with a rental.

• Renter must be at least 21 years of age at the time of rental.
• Renter must possess a valid driver's license issued by a U.S. state or, for international visitors, a valid foreign license accompanied by an International Driving Permit (IDP).
• Renter must present a valid credit or debit card in their name at pickup.
• Renter must not have a suspended, revoked, or otherwise invalid license at any point during the rental period.

Only the person listed on the rental agreement is authorized to operate the vehicle unless an additional driver has been pre-approved in writing by Modern Rent A Car. Unauthorized use of the vehicle by a third party is a violation of this agreement and may result in full liability for any damages, loss, or claims arising from such use.

All rentals must be covered by valid insurance for the duration of the rental period. Renters may provide coverage in one of two ways:

• Personal Auto Insurance: If your existing personal auto policy or credit card benefit extends coverage to rental vehicles, you may use that coverage. It is your responsibility to verify this with your insurer before pickup.
• Our Insurance Option: We offer an insurance plan that can be purchased at the time of booking. Details and pricing will be provided during the reservation process.

Proof of valid coverage must be presented at pickup. Rentals will not proceed without confirmed insurance in place.

At pickup, both parties will conduct a joint inspection of the vehicle. Any pre-existing damage will be noted on the rental agreement. The Renter is strongly encouraged to photograph the vehicle before departure. Modern Rent A Car is not responsible for damage claims made after the vehicle has left our possession that were not documented at pickup.

The vehicle must be returned by the agreed-upon date and time in the same condition it was received, with a full tank of fuel. Late returns may be subject to additional daily rental charges. The vehicle must be returned to the agreed-upon location unless otherwise arranged in advance.

Fuel Policy: Vehicles are provided with a full tank and must be returned full. A refueling fee will apply if the vehicle is returned with less than a full tank.

The Renter agrees to:

• Operate the vehicle in compliance with all applicable federal, state, and local traffic laws.
• Not operate the vehicle under the influence of alcohol, drugs, or any substance that impairs driving ability.
• Not use the vehicle for any illegal purpose or activity.
• Not use the vehicle for hire, rideshare, or commercial purposes (e.g., Uber, Lyft, DoorDash) unless explicitly authorized in writing.
• Not transport the vehicle outside agreed geographic boundaries without prior written consent.
• Not allow smoking inside the vehicle. A cleaning fee of up to $250 will be charged for violations.
• Not transport pets without prior approval. An additional cleaning fee may apply.
• Not tow any vehicle, trailer, or object with the rental vehicle.

The Renter is responsible for all damage to the rental vehicle that occurs during the rental period, including damage caused by accident, collision, theft, vandalism, weather, or any other cause, regardless of fault — unless covered by the Renter's insurance or our offered insurance plan.

In the event of an accident or damage, the Renter must:

• Notify Modern Rent A Car immediately at (864) 764-1733.
• File a police report if required and provide us with a copy.
• Not admit fault or liability to any third party without our consent.
• Cooperate fully with any insurance investigation.

In the event of a breakdown, flat tire, or other roadside emergency, please contact us immediately. Do not attempt major repairs yourself. Costs arising from unauthorized repairs will not be reimbursed.

Cancellations made 48 hours or more before the scheduled pickup time will receive a full refund. Cancellations made within 48 hours of scheduled pickup may be subject to a cancellation fee equivalent to one day's rental rate. No-shows will be charged the full reservation amount.

The following additional fees may apply:

• Late Return: Charged at the daily rental rate per day or partial day.
• Fuel Fee: Applied if the vehicle is returned with less than a full tank.
• Smoking/Pet Cleaning Fee: Up to $250 depending on severity.
• Lost Key Fee: Replacement cost plus any associated locksmith or towing fees.
• Toll Violations & Parking Tickets: The Renter is solely responsible for all tolls, parking tickets, and traffic violations incurred during the rental period, plus an administrative fee.

Modern Rent A Car shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our rental vehicles. Our total liability to you for any claim arising from a rental shall not exceed the total amount paid for that rental.

These Terms and Conditions are governed by the laws of the State of South Carolina. Any disputes arising from or related to these terms shall be resolved in the courts of Spartanburg County, South Carolina.

We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with a revised "Last updated" date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
